Federal immigration laws make it mandatory for employers to verify the employment eligibility of all employees hired after November 6, 1986. To meet this requirement, employers must complete an I-9 form for every employee and maintain them for a minimum of three

years after the date of hire or one year after employment terminates, whichever is later. Failure to comply with the Immigration Reform and Control Act of 1986 subjects employers to civil or criminal penalties including fines. In October 2004, the President signed Public Law 108-390, which authorized the use of electronic signatures and storage for I-9s. DHS published the electronic
I-9 rule in the Federal Register in June 2006.


eVerify

E-Verify is a voluntary, online service from the U.S. Department of Homeland Security that verifies a new hire’s work eligibility against SSA and DHS databases and returns the result in seconds. E-Verify also helps minimize or eliminate liability for employers. The system can only be used to verify new hires. It cannot be used to verify existing employees or for pre-screening purposes. The I-9 must be completed before submitting an E-Verify query.

Many states have proposed or passed laws making E-Verify mandatory for employers. The TALX I-9 service allows E-Verify to be controlled at the state and hiring location level so you can easily comply with state laws or specific contract requirements.
